Terms of Service
The rules and guidelines for using the Quote platform

1. Introduction and Acceptance
Welcome to Quote. These Terms of Service ("Terms") govern your access to and use of the Quote website, mobile applications, and services (collectively, the "Platform") operated by Quote Pty Ltd (ABN: XX XXX XXX XXX) ("Quote", "we", "us", or "our").
By creating an account or using the Platform, you agree to be bound by these Terms, our Privacy Policy, and Cookie Policy. If you do not agree, do not use the Platform.
If you are using the Platform on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. The Platform
Quote is an online marketplace and business management platform that connects customers seeking trade services ("Customers") with licensed tradespeople and trade businesses ("Tradies"). We provide the technology platform to facilitate these connections and help tradies manage their businesses, but are not a party to any agreement between Customers and Tradies.
Quote is not:
- An employer of Tradies
- A contractor providing trade services
- Responsible for the quality of work performed by Tradies
- A party to contracts between Customers and Tradies
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Platform. If you are a Tradie, you must hold all licences required to perform your trade in your state or territory.
3.2 Account Information
You must provide accurate, current, and complete information when creating your account and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
3.3 One Account Per Person
You may only maintain one account per person. Creating multiple accounts to circumvent restrictions or manipulate the Platform is prohibited and may result in account termination.
4. Customer Terms
4.1 Posting Jobs
When posting a job, you must provide accurate descriptions of the work required. Jobs must be for legitimate trade services and comply with all applicable laws.
4.2 Accepting Quotes
When you accept a quote from a Tradie, you enter into a direct contract with that Tradie. Quote is not a party to this contract. Review quotes carefully before accepting, as acceptance creates a binding agreement.
4.3 Payment
You agree to pay for services as agreed with the Tradie. Payments made through the Platform are processed by our payment provider (Stripe) and are subject to their terms. Quote may hold funds in escrow and release them upon job completion as agreed.
5. Tradie Terms
5.1 Licence and Insurance Requirements
Tradies must hold all licences required by their state or territory to perform their trade. Tradies must maintain appropriate public liability insurance (minimum $10 million recommended) and provide proof when requested.
5.2 Verification
Tradies may apply for verification badges by submitting documentation. Quote verifies information against official sources where possible but does not guarantee the accuracy of all verified information. Verification is not an endorsement.
5.3 Quotes and Services
Quotes submitted through the Platform must be accurate and include all foreseeable costs. Tradies must perform work to a professional standard and in accordance with relevant Australian Standards, building codes, and regulations.
5.4 Fees
Tradies may be charged subscription fees, lead fees, or commission on completed jobs as described in our pricing page. Fees are subject to change with 30 days' notice. Tradies are responsible for their own tax obligations, including GST.
6. Prohibited Conduct
You agree not to:
- Violate any applicable law or regulation
- Provide false or misleading information
- Impersonate another person or entity
- Circumvent the Platform to avoid fees (e.g., exchanging contact details to complete transactions offline)
- Post or transmit spam, malware, or harmful content
- Harass, threaten, or discriminate against other users
- Scrape, data mine, or use automated tools to access the Platform
- Interfere with the Platform's operation or security
- Manipulate reviews, ratings, or other feedback mechanisms
- Engage in price fixing or other anti-competitive behaviour
7. Reviews and Ratings
Users may leave reviews and ratings after jobs are completed. Reviews must be honest, accurate, and based on genuine experiences. We may remove reviews that violate these Terms or our community guidelines. Quote does not verify the accuracy of reviews.
8. Disputes Between Users
Disputes between Customers and Tradies should first be resolved directly between the parties. If resolution is not possible, either party may request Quote's dispute resolution assistance. Quote may, at its discretion, mediate disputes, withhold payments, or take other actions it deems appropriate, but is not obligated to resolve disputes.
For disputes involving significant amounts or legal complexity, parties should seek independent legal advice or use formal dispute resolution mechanisms (e.g., state consumer tribunals).
9. Intellectual Property
The Platform, including its design, features, content, and trademarks, is owned by Quote and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
Content you post (e.g., job descriptions, photos, reviews) remains yours, but you grant Quote a non-exclusive, royalty-free, worldwide licence to use, display, and distribute such content in connection with the Platform.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. QUOTE DOES NOT WARRANT THAT:
- The Platform will be uninterrupted, secure, or error-free
- Tradies will perform work satisfactorily
- Verification information is complete or accurate
- The Platform will meet your requirements
To the maximum extent permitted by law, including the Australian Consumer Law, we disclaim all warranties. Nothing in these Terms excludes or limits consumer guarantees that cannot be excluded under Australian law.
11. Limitation of Liability
To the maximum extent permitted by law, Quote's total liability to you for any claims arising from or related to the Platform is limited to the greater of: (a) the amount you paid to Quote in the 12 months before the claim; or (b) $100 AUD.
Quote is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
Quote is not liable for the acts or omissions of Tradies, including the quality of work performed, property damage, or personal injury.
12. Indemnification
You agree to indemnify and hold harmless Quote, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any law or third-party rights
- Disputes with other users
13. Termination
You may close your account at any time through your account settings. Quote may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or other reasons at our discretion.
Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive (e.g., intellectual property, disclaimers, limitation of liability, indemnification).
14. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of New South Wales.
15. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by posting on the Platform or emailing you. Continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
16. General
- Entire Agreement: These Terms constitute the entire agreement between you and Quote regarding the Platform.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Failure to enforce any right is not a waiver of that right.
- Assignment: You may not assign these Terms without our consent. We may assign these Terms freely.
